Terms of Use

1. Purpose

These Terms of Use govern access to and use of the ThumbUp platform.

2. Acceptance

Use of the service implies full acceptance of these Terms of Use and the Privacy Policy.

3. Account Creation and Login

  • Users must provide accurate information at registration.
  • Email verification is required to activate access.
  • Each user is responsible for keeping their credentials confidential.
  • Any unauthorized access attempt or security bypass is prohibited.

4. Authorized Use

  • Professional use only for thumbnail order management.
  • Uploading unlawful, infringing, or third-party rights violating content is prohibited.
  • Disrupting the platform (abusive scripts, attacks, mass extraction) is prohibited.

5. Payments and Billing

  • Payments are processed by external providers (PayPal and/or Stripe).
  • Provider terms apply in addition to these Terms of Use.
  • ThumbUp does not store complete card information.
  • Payment statuses displayed in the application are deemed valid unless proven otherwise.

6. Service Availability

ThumbUp aims for continuous availability but may experience interruptions due to maintenance, upgrades, or incidents.

7. Intellectual Property

Platform elements remain the exclusive property of their respective owners. No ownership transfer is granted beyond the strictly necessary right to use the service.

8. Liability

  • Users are responsible for the lawfulness of content they submit.
  • ThumbUp is not liable for indirect damages, data loss, or loss of business.
  • ThumbUp liability is limited to amounts actually paid over the previous 12 months, except in case of gross negligence.

9. Suspension and Termination

In case of serious breach of these Terms, access may be suspended or terminated without prior notice, without prejudice to any legal action.

10. Personal Data

Data processing rules are detailed in the Privacy Policy.

11. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute falls under the jurisdiction of the competent courts where the publisher is located, subject to mandatory public policy protections.
